General Conditions

§ 1 Applicability: a. The registration and participation in Events and Workshops organized by the Zhigong Institute Europe.

§ 2 Registration: a Upon registering, the student accepts our general Terms and Conditions. b. Personal data will be stored electronically in accordance with the law of privacy. c. Registration is possible online, via email or phone.

§ 3 Payment: a. Payment of all registration fees must be received prior to attendance. The Zhigong Institute Europe will send the invoice via email. The bill gives the date on which the Workshop fee must be paid.

§ 4 Cancellation and refunds:
a. Workshops: Upon cancellation, you will have to pay a fee of 30 Euro for administration costs. Cancellation 14 days or prior to the Workshop will attract a 50% cancellation fee. Cancellations 7 days or prior to the Workshop will attract an 80% cancellation fee. Cancellations less than 7 days prior to the Workshop are non-refundable.
b. Workshops with Chinese Teachers/Masters without accommodation: Upon cancellation, you will have to pay a fee of 30 Euro for administration costs. Cancellation 60 days prior to the Workshop will attract a 35% cancellation fee. Cancellations 30 days or prior to the Workshop will attract a 75% cancellation fee. Cancellations less than 14 days to the Workshop are non-refundable.
c. Travel/Workshops with Chinese Teachers/Masters including accommodation and meals: Upon cancellation, you will have to pay a fee of 30 Euro for administration costs. Cancellation 90 days prior to the Workshop will attract a 50% cancellation fee. Cancellations 60 days or prior to the Workshop will attract a 75% cancellation fee. Cancellations less than 30 days to the Workshop are non-refundable.

§ 5 Changes made by the Zhigong Institute Europe:
a. The Zhigong Institute Europe reserves the right to postpone or cancel a Workshop (e.g. due to insufficient registration) in which case we will offer you an alternative Workshop date or a full refund of all Registration Fees.
b. We may change the venue of the Workshop for any reason (e.g. higher than anticipated attendance numbers). We may vary the Workshop program to deal with any unforeseen circumstances, provided the content of the Workshop is not substantially altered.

§ 6 Changes or cancellation of events:
a Zhigong Netherlands Institute reserves the right, in case of serious reasons (e.g. force majeure, sudden illness of the instructor) or insufficient enrollment events to cancel or oppose. The students are immediately informed about this.
b. In case of cancellation shall be paid the course, fee refunded. Other claims regarding a cancellation excluded.
§ 7 Intellectual property rights
a. Nothing in these Terms grants you any intellectual property rights in respect of the program and content of the Workshop and materials provided at the Workshop (Materials). You may not use any of our intellectual property without our prior written consent and must comply with any conditions we impose in relation to such use.
b. You must notify us immediately if you become aware of any actual or threatened infringement of any of our intellectual property rights and must provide us all reasonable assistance in relation to preventing such infringement.
c. You acknowledge that the value of our intellectual property right is such that an award for damages might not be and adequate remedy for breach of this clause 8 and that we may, without having to prove any actual damage, take any action or seek any remedy including seeking an injunction.

§ 8 Limitation of liability and indemnity
a. To the extent permitted by law we, and all other persons involved in the preparation, production and presentation of the Workshop and Materials (Third Parties), will be under no liability whatsoever to you in respect of any loss or damage (including consequential loss or damage) which you may suffer or incur (directly or indirectly) in connection with or as a result of the Workshop or these Terms whether arising from any act or omission negligent or otherwise by us or the Third Parties.
b. Without limiting clause 8 (a), if we or a Third Party are rendered liable in any way in relation to, or arising from, the Workshop or these Terms such liability will at our option or the Third Party’s option as appropriate and to the extent permitted by law be limited to refund of the Registration Fees.
c. You indemnify us and each member of our personnel on a full and continuing indemnity basis from and against any liability or claim arising directly or indirectly in relation to your breach of these Terms or any act or omission negligent or otherwise by you.
d. In relation to this clause we act in our own capacity and as agent for the Third Parties.

§ 9 No warranties
a. The Workshops and Materials are provided without warranties of any kind, either express or implied and any condition or warranty which would otherwise be implied in these Terms is excluded.
b. Where legislation or other law implies any condition or warranty in relation to these Terms and that law avoids or prohibits provisions in a contract excluding or modifying the application of or exercise of or liability under such condition or warranty, the condition or warranty is included or implied in these Terms. Our liability under any such condition or warranty will, at our option and to the extent permitted by law, be limited to the Registration Fees.
